Terms of Service

These terms are an agreement between you and ESARC Technologies Inc. (“ClearProp”, “we”).

1. Acceptance of terms

By using the ClearProp app or website, you agree to these terms and to our Privacy Policy. If you do not agree, do not use ClearProp.

2. The service

ClearProp provides tools for general aviation route planning, advisory in-flight navigation context, offline route preparation, nearby airport awareness, and pilot-reviewed logbook drafts. Beta features may be incomplete, may change, or may be temporarily unavailable.

3. Aviation safety

ClearProp is advisory only. It is not a certified electronic flight bag or a primary navigation source, and it does not replace current official charts, publications, weather, NOTAMs or your own preflight planning. The pilot in command is solely responsible for the safe operation of the aircraft. Read the full aviation disclaimer, which forms part of these terms.

4. Logbook drafts and records

Navigation sessions may prefill a logbook draft. You must review and correct every entry before you save it, and you remain responsible for any records your regulator or operator requires. ClearProp does not make a draft an official record on your behalf.

5. Your account

Keep your sign-in credentials safe. You are responsible for activity under your account. You can delete your account at any time in the app or through our account deletion page.

6. Your content and community routes

You keep ownership of the data you add. You give ClearProp the permission it needs to store, process and display that data to provide the service. When you publish a community route, you allow other pilots to view and save a copy of it. Only publish routes you have the right to share.

7. Acceptable use

  • Do not interfere with or disrupt the service.
  • Do not try to access other pilots’ data.
  • Do not use ClearProp for an unlawful purpose.
  • Do not publish misleading or unsafe community routes.

We may suspend accounts that break these rules or put other users at risk.

8. Third-party data

Maps, airport, airspace and procedure information come from third-party and government sources. That data may be incomplete, delayed or out of date, and it is subject to its providers’ terms.

9. Availability and warranties

ClearProp is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. Offline data may be unavailable, incomplete or outdated.

10. Limitation of liability

To the extent the law allows, ClearProp is not liable for damages arising from reliance on the service, loss of connectivity or data, or failure to use current official aviation information. Where liability cannot be excluded, it is limited to the greater of CAD $100 or the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection law that cannot be waived.

11. Governing law

These terms are governed by the federal laws of Canada and the laws of the province where ESARC Technologies Inc. has its registered office, without limiting any consumer protection rights you have where you live.

12. Changes

We will update the date above when these terms change and tell you in the app or by email before a material change takes effect.
